These Terms cover mariamercedesre.com and the matching service behind it, both operated by Maria Mercedes Home Solutions. Use the site or call the line and you're accepting them. We wrote them to be readable, because a wall of legalese would undercut everything else this site says about plain dealing. Questions go to [email protected].

What This Service Is

Maria Mercedes Home Solutions is a referral service. We connect homeowners who want a fast cash sale with independent real estate investors and home buying companies, and those buyers compensate us for the introductions. That's the entire business model, and it's why you never pay us anything.

Just as important is what we're not. We are not a licensed real estate brokerage, and nobody here acts as your agent. We don't buy homes ourselves, we don't hold funds in escrow, and we never take title to your property. Every offer you receive comes from an independent buyer, not from us.

No Agency Relationship, No Professional Advice

Using this service creates no agency or fiduciary relationship between you and us. Nothing on this site, and nothing said on a call with us, is legal, tax, or financial advice. Foreclosure deadlines carry real legal weight. So do probate rules, capital gains questions, and divorce settlements. Guidance you can rely on for those must come from a licensed attorney or CPA in your state. Our content is general information, written carefully but never tailored to your file.

Offers Come From Independent Investors

Any price or contract term you hear originates with the investor making the offer. Investors in our network are separate businesses that set their own numbers and sign their own contracts. We screen for proof of funds and track record before adding anyone, but screening isn't a guarantee, and we can't promise how a particular buyer will perform on your particular deal.

So verify before you sign. Read the whole contract. Confirm the earnest money amount and where it's held. Check who's actually named as the purchaser and whether the agreement can be assigned to someone else. Ask what happens if the buyer cancels. And if anything feels rushed, have a real estate attorney read it first. That review runs a few hundred dollars and has saved sellers many thousands.

No Warranty

The site and the matching service come "as is" and "as available." We don't warrant that a buyer will make an offer, that an offer will reach any particular amount, or that a closing will happen on any schedule. To the extent the law allows, we disclaim implied warranties, including merchantability and fitness for a particular purpose. Some states restrict these disclaimers, so parts of this section may not apply to you.

Limitation of Liability

To the maximum extent permitted by law, Maria Mercedes Home Solutions isn't liable for what happens between you and an independent buyer. Offer amounts, renegotiations, failed closings, contract disputes, and anything else arising from the transaction sit with the parties to that transaction, meaning you and the buyer. If a court finds us liable despite this section, our total liability is capped at one hundred dollars ($100), a figure reflecting a service you never paid for. We're not liable for indirect, incidental, consequential, or punitive damages under any theory.

Indemnification

If your misuse of the site, your violation of these Terms, or your dealings with a buyer produces a claim against us, you agree to defend us and cover the resulting costs, including reasonable attorney fees. This obligation doesn't extend to claims caused by our own wrongdoing.

Calls, Texts, and Recording

Submitting your phone number, or calling one of our numbers, means you consent to calls and texts about your request from us and from the buyers we introduce, including autodialed and prerecorded messages. That consent isn't required to sell your home or to use the site. Calls may be recorded. Our Privacy Policy has the details, including how to withdraw consent with a single text or email.

Acceptable Use

Use the service honestly. Submit requests only for property you own or have legal authority to sell. Don't send fake inquiries. Don't scrape or republish the site's content, don't probe it for security weaknesses, and don't pose as another person. We can decline or end service for anyone who breaks these rules.

Intellectual Property

The text and graphics on this site, along with the Maria Mercedes Home Solutions name, belong to us or our licensors. Linking to the site is welcome. Copying pages for republication is not, and neither is using our name in a way that implies we endorse you.

Governing Law, Arbitration, and Class Waiver

Delaware law governs these Terms, without regard to conflict of law principles. If a problem comes up, email us first, since most issues resolve with a conversation. If we can't fix it informally within 30 days, both sides agree to settle the dispute through binding individual arbitration under the American Arbitration Association's Consumer Arbitration Rules rather than in court. You keep the right to bring qualifying claims in small claims court.

Class action waiver. Disputes proceed one at a time. Neither you nor we may join a class action or class-wide arbitration against the other. Should a court rule this waiver unenforceable for some claim, that specific claim goes to court while the rest of this section survives.

You may reject arbitration entirely by emailing [email protected] within 30 days of your first use of the service, with your name and phone number, stating that you decline arbitration. Every other part of these Terms still applies.

Severability

If any provision here fails legally, it gets narrowed to whatever the law will enforce, and the remaining provisions carry on untouched.

Changes to These Terms

We'll revise these Terms when the service or the law calls for it. The date at the top marks the current version, and meaningful revisions appear here before they take effect. Continued use after a change counts as acceptance.
